TICKETS TERMS & CONDITIONS
Introduction
CURLYTREATS strives to provide an inclusive, family-friendly environment for its events where visitors, exhibitors and the Event team can enjoy their shared passion for natural hair care and styling at all times. Nia Phoenix Ltd (NP) organises CURLYTREATS.
Definitions and Interpretation
• ‘We’, ‘Our’, ‘Ours’, ‘Us’ and 'the Organisers' refers to Nia Phoenix Ltd
• 'You', 'Yours' refers to you or anybody who in our reasonable opinion, is acting with your authority or permission.
• 'The Event' refers to the CURLYTREATS event
• ‘Venue’ means any facilities or location where the Event is being held
• 'Ticket' refers to electronic evidence of the right to attend the Event
• 'Visitors' applies to ticket holders attending the Event.
Legal Agreement
By ordering tickets to CURLYTREATS, You confirm that you have read and accept the Terms and Conditions in their entirety.
To register a ticket to attend CURLYTREATS, you must be over 18 years old.
Your possession of a CURLYTREATS ticket constitutes that you have read, understood and agree to be legally bound by the:
• Tickets Terms and Conditions
• Any special terms and conditions stated to apply to a specific ticket type, the Event or both.
You also consent to receive your ticket by email as well as receiving regular updates regarding CURLYTREATS.
If you do not agree or if you cannot comply with any of these conditions, then you must not register tickets to attend the Event.
Ticket Types
Access at CURLYTREATS depends on the ticket registration type.
Ticket Prices
All prices for tickets offered for sale from CURLYTREATS are inclusive of VAT.
Ticket prices are set at the time of the initial on-sale and usually stay the same.
However, CURLTREATS ticket partner may offer tickets at a reduced price on their website. You will not be entitled to a refund or credit if tickets are advertised at a decreased price after you purchase your ticket.
Ticket Payment and Placing Orders
Please ensure that you read the full ticket description details and are happy with your ticket selection before completing your order as the Organisers are unable to rectify issues arising as a result of your mistake.
It is your responsibility to check your ticket; the Organisers shall not be responsible for any issues you make when booking.
These terms and conditions starts once the Organisers confirms your ticket order. It ends immediately after completion of the Event for which you have registered a ticket.
It is your responsibility to confirm via your Eventbrite account whether or not your order is complete:
• If you do not receive an order confirmation after submitting payment information contact Eventbrite
• If you experience an error message or service interruption after submitting payment information, please contact Eventbrite.
Only you may be aware of any problems that may occur during the purchase process.
CURLYTREATS will not be responsible for any costs or losses you incur if you assume that an order was or was not placed because you failed to receive an order confirmation.
Ticket Restrictions
When registering tickets from CURLYTREATS, you are limited to a specified number of tickets for each Event. This number is included on the first purchase page and verified with every order. This condition is in effect to discourage and prevent unfair ticket registering practices.
Tickets restricted to:
• a maximum number per person,
• per credit or debit card and,
• maximum capacity for some events,
• and a restriction may apply per household as well.
We reserve the right to cancel any order(s) for tickets purchased more than the limits without notice.
Ticket Resell
You can not resell your tickets. Any resale (or attempted resale) of a ticket is in breach of the law and is grounds for seizure or cancellation of that ticket without refund or other compensation.
Misuse of Ticket
No tickets allowed for advertising, promotions, contests or sweepstakes (or for other such similar commercial gain).
Tickets may not be combined with any hospitality, travel or accommodation service or any other merchandise, product or service to create a package for sale or additional distribution.
No Partnership or Agency
Nothing in these Tickets Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions.
Ticket Touts
Do not buy tickets from unlawful street traders/touts. There is no guarantee of ticket validity for entry unless purchased directly from CURLYTREATS and an official Ticket Partner.
Ticket Partner
These Tickets Terms and Conditions do not apply to any purchases made from Groupon. We act solely as Groupon's fulfilment partner and are not responsible for any aspects of your purchase from Groupon, except for access to the Event based on your ticket type. If you have any queries or complaints regarding your purchase of tickets from Groupon, please contact them directly. Our Admission Policy does apply to ticket purchases made from Groupon.
Intellectual Property
All intellectual property rights are owned by CURLYTREATS and its Organisers, any and all breaches will be prohibited. Any professional still photos, moving images, videos, sound recording taken and/or published and/or uploaded and/or distribution without priority written consent from CURLYTREATS will contribute a violation of the intellectual property rights. All breaches will be prohibited.
Event Timing
The advertised start and end times of the Event are subject to change.
Event Programme
The Organisers reserve the right to change the content, speakers, timing and Venue of the CURLYTREATS event at any time - without being obliged to refund monies or exchange tickets.
Seating
Seats in the conference will be available on a first-come, first-served basis and are not guaranteed.
Latecomers
Generally, every effort to admit latecomers will be made at a suitable break in the Event, but admission cannot always be guaranteed to scheduled sessions.
Views and Opinions
The views and opinions expressed by any talent, speaker, exhibitor, sponsor, visitor at the Event are their own. The Organisers shall not be responsible for any advice given or view expressed at the Event or in any material provided to you.
Personal cancellation
Make sure when you book your ticket, you can attend the Event. The ticket is for personal use only. Once you have booked your ticket, the Organisers won't be able to cancel or amend it.
Cancelled and Rescheduled Events
If an event is cancelled or rescheduled, the Organisers will get in touch with you to let you know once the relevant information is given (if you booked online, the Organisers would use your email address).
However, the Organisers can not guarantee that you will be informed of such cancellation, postponement, rescheduling or alteration before the date of the Event. It is your responsibility to ascertain whether an event is cancelled in full, postponed, rescheduled or altered and the date and time of any rescheduled event.
Refunds for Postponed Rescheduled Events
Refunds cannot be provided. You ticket will be transferred to the rescheduled event.
You will not be compensated for any losses, e.g. travel costs.
Refunds from Event Cancellation
The cancellation of an event means that it will not take place in the future.
For an event cancellation, we issue refunds in the form of an E-Gift Card (or store credit) to be used on future purchases. E-Gift Cards expire after 24 months and can be treated just like cash on our online store.
You will not be compensated for any losses, e.g. travel costs.
Refunds from Ticket Partner
The Organisers is not responsible for any tickets not purchased through a Ticket Partner; accordingly, if there is a cancellation, the Organisers will not be liable to you for a refund for the ticket. You will need to contact the Ticket Partner for a refund which can be in the form of credit, e.g. Groupon. For Events that are postponed or rescheduled, tickets will be valid for the next Event only.
Force Majeure
The Organisers shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God (other than one arising from or related to directly or indirectly from volcanic ash), strikes, lockouts, healthy and safety issues, accidents, war, fire, breakdown of plant or machinery, and Nia Phoenix Ltd trading as CURLYTREATS shall be entitled to a reasonable extension of its obligations.
Damages and losses
The Organisers accepts no liability for personal or property damages, losses (including surrendered items) or injuries sustained at this Event - other than caused as a result of Our negligence.
The Organisers may prosecute you if you cause damage to the Venue or cause harm to any other person at the Event, Venue or both.
Changes
CURLYTREATS reserves the right from time to time to make changes to these Tickets Terms and Conditions. It is Your responsibility to check and stay informed of any changes regularly.
All registered tickets are subject to these Tickets Terms and Conditions and Admission Policy.
If you do not agree or if you cannot comply with any revisions to these terms and conditions, then you must not register any tickets.
Queries, Complaints and Dispute Resolution
If the Organisers needs to contact you, We will use the contact details you provided at the time of your ticket registration. It is your responsibility to inform us immediately of any changes to your contact details, whether before or after ticket confirmation.
In particular, please ensure that you provide us with a valid email address as this is Our preferred method of contacting you. You should also be aware that your email mailbox settings may treat Our emails as junk, so remember to check your junk, spam or both folders.
If you have any queries or complaints regarding your purchase, please contact us at [email protected] quoting any order reference numbers.
Your query or complaint shall be acknowledged by us as soon as possible and in any event, within ten business days of receipt.
We may need to contact an Event Partner for more information before responding to your query or complaint.
If any dispute arises, We shall use Our reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to you, us and any relevant Event Partner. Please note, some complaints can take as much as 28 days to resolve.
Nothing in this Tickets Terms and Conditions affects or restricts your statutory rights, your right to make a complaint to Trading Standards or another appropriate regulatory authority, or your right to pursue court proceedings or other forms of dispute resolution.
Waiver
If We delay or fail to enforce any of these Tickets Terms and Conditions, it shall not mean that We have waived Our right to do so.
Assignment
We shall be entitled to assign any of Our rights and obligations under these Tickets Terms and Conditions provided that your rights are not adversely affected.
Severability
If a Court finds that any of these Tickets Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
If any provision of these Tickets Terms and Conditions is or becomes illegal, invalid or unenforceable under the law of any applicable jurisdiction, this shall not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of these Tickets Terms and Conditions.
Third Parties
the Event Partner(s) and its affiliates, successors or assigns may rely on any rights set out in these Terms and Conditions under the provisions of the Contracts (Rights of Third Parties) Act 1999 (the ‘Act’). Except as provided above, any person who is not a party to these Tickets Terms and Conditions shall have no rights under the Act to rely on any of these Tickets Terms and Conditions. The Act can give rights under some contracts to third parties who are not parties to those contracts, but in this case on We, the Event Partner(s) (and/or its affiliates, successors or assigns) and you (or your assignees permitted as a result of this) have rights and obligations under this contract.
Entire Agreement
These Tickets Terms and Conditions, and the terms and conditions of the Venue and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Tickets Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Tickets Terms and Conditions or not) other than as expressly communicated by Us to You before You have completed your purchase or set out in these Tickets Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
Governing Law and Jurisdiction
These Tickets Terms and Conditions shall be governed by and construed in all respects under English law, and the parties agree to submit to the exclusive jurisdiction of the English courts.
