Tickets Terms and Conditions

CURLYTREATS® (“Event”) is organised by Nia Phoenix Ltd, a company registered in England and Wales. Our company registration number is 10244719 and our registered office is at 71-75 Shelton St, London WC2H 9JQ (“Organiser, we”, “us”, “our”). The term "you”, “Ticket Holder” refers to the person who registered / purchase ticket(s) from this website or Eventbrite.

LEGALLY BINDING CONTRACT

a) In order to make a purchase from us, you must be 18 years old or more and able to enter into legally binding contracts.
b) Any registration / purchase from us forms a legally binding contract that is subject to: (1) these Tickets Terms and Conditions (2) any special terms and conditions stated to be applicable to an Item and/or event; (3) any venue terms and conditions (including conditions of entry), (4) this website’s Privacy Policy and Terms of Use . You should read these Tickets Terms and Conditions carefully before you make a purchase.
c) By registering / purchasing one or more ticket(s) from us, you acknowledge that you have read, understood and agree to be bound by the Tickets Terms and Conditions. If you do not agree with these Tickets Terms and Conditions or any other applicable terms and conditions, or if you cannot comply with any of them, then you must not make a purchase or register.
d) We reserve the right from time to time to make changes to the Tickets Terms and Conditions. Where we make any such changes, we shall post the updated version of the Tickets Terms and Conditions page on our website. Therefore, we recommend you check the Tickets Terms and Conditions regularly to stay informed of its current terms and conditions. All registered / purchases are subject to the applicable version of this Tickets Terms and Conditions that was published at the time of purchase. If you do not agree with any revised version of this Tickets Terms and Conditions, or if you cannot comply with it, then you must not make a purchase.

TICKETS

a) In this Tickets Terms and Conditions, we refer to any products and services offered for sale by us (including Tickets, Community Tickets, Conference Tickets, and Packages) as “Items”” and “Tickets”.
b) If you register / purchase your ticket from directly from this website or Eventbrite, you will be sent an Email Confirmation Ticket or E-tickets. Show your Ticket on your mobile device to gain entry or print your ticket. Photo ID may be required with proof of purchase.
c) For some events, we may sell different types of Tickets, items and packages, including:
(1) COMMUNITY TICKETS are complimentary General Admission ticket to CURLYTREATS® community expo. Access to the natural hair, beauty and fashion exhibitors. Entry based on capacity. No re-entry. No access to scheduled activities.
(2) CONFERENCE TICKETS - ALL ACCESS are paid tickets, giving the ticket holders full access to the event. Access to ALL main stage hair care and styling educational sessions and an event bag. Plus access to the natural hair, beauty and fashion exhibitors within the CURLYTREATS® marketplace.
d) Do not buy tickets from unlawful street traders / touts. There is no guarantee of tickets’ validity for entry unless purchased directly from us.
e) These Terms and Conditions does not apply to any purchases made from Groupon or from any other third parties. We act solely as Groupon's fulfilment partner and are not responsible for any aspects of your purchase from Groupon, save for delivery of tickets to you.  If you have any queries or complaints regarding your purchase of tickets from Groupon or other third parties, please contact them directly.

PRICES, PAYMENT AND PLACING ORDERS

a)All prices for Items offered for sale from us are exclusive of VAT
b) In many circumstances, Ticket prices are set at the time of the initial on-sale and stay the same until the event. However, some Tickets are "market-priced," and so Sale Prices may increase or decrease at any time, based on demand. This is similar to how airline tickets and hotel rooms are sold and is commonly referred to as "Dynamic Pricing". You will not be entitled to a refund or credit if (i) the Sale Price you paid for a Ticket was at any time before you purchased your Ticket less than the Sale Price you paid; or (ii) the Sale Price of any other Tickets to the relevant event (whether in the same price category or otherwise) is/are subsequently reduced after you purchase your Ticket.
c) our contract for purchase starts once we have confirmed your order and ends immediately after completion of the event for which you have purchased ticket(s).
d) If you do not receive an order confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via your Eventbrite account whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for any costs or losses you incur if you assume that an order was or was not placed because you failed to receive an order confirmation.
e)All purchases are subject to credit or debit card verification (if applicable), other security checks, and collection of payment by us. Your order may be cancelled if it has not passed our verification process or if payment is not received in full.  In rare circumstances, if your payment is recalled by the associated bank or payment provider, we reserve the right to cancel and refund any order for which an order confirmation has been sent.  We accept no responsibility or liability for such cancellations, as these are outside our control.
f)To prevent fraud and protect us, we reserve the right to carry out checks and/or request that additional information be provided in order to verify purchases. We reserve the right to cancel any orders that we reasonably suspect to have been made fraudulently, without any notice to you, and any and all Items obtained as part of such orders will be void.
g) Please ensure that you read the full Item description details and are happy with your selection prior to purchase as we may be unable to rectify issues arising as a result of your mistake.
h) It is the your responsibility to check your tickets, as mistakes cannot always be rectified, and we shall not be responsible for any issues you made when booking.

TICKET RESTRICTIONS

a) When purchasing Tickets from us, you are limited to a specified number of Tickets for each event. This number is included on the first purchase page and is verified with every order. This condition is in effect to discourage and prevent unfair ticket registering practices. We reserve the right to cancel any order(s) for Tickets purchased in excess of the relevant limits without notice.
b) Tickets may be sold subject to certain restrictions on entry or use, such as restricted, obstructed or side view or a minimum age for entry. Any such restrictions will be displayed or otherwise notified to you before or at the time of booking. It is your responsibility to ensure that you read all notifications and other important information displayed or notified to you as part of the purchase process. We will not be responsible if you or any guests under your booking are refused admission because of a failure to meet or prove that you/they meet any restrictions (e.g. a minimum age requirement).
c) You may not resell or transfer your Tickets if prohibited by law. Any resale or transfer (or attempted resale or transfer) of a ticket in breach of the applicable law or any restrictions or prohibition imposed by the Organiser is grounds for seizure or cancellation of that Ticket.
d)Tickets purchased from us may not:
(1) be used for advertising, promotions, contests or sweepstakes (or for other such similar commercial gain); and/or
(2) be combined with any hospitality, travel or accommodation service and/or any other merchandise, product or service to create a package for sale or other distribution,
unless formal written permission is given by us in advance and provided that even if such permission is granted, use of our trademark and other intellectual property is subject to the express prior written consent of the owner.
e) Ticket holders can not conduct leafleting or place marketing materials anywhere inside or outside the event. Marketing materials place at the event e.g on tables, toilets, etc will be removed. Ticket holders who do not abide by our terms and conditions will be escorted off the premises. It’s essentials that all ticket holders are given a good experience at the event.
f) No trading or promotional activities allowed within and outside the venue without the Organiser’s prior consent.
g) No filming in the conference, including but not limited to main stage sessions is permitted.
h)All sound and moving or still picture rights including, without limitation, on the internet, vest exclusively with the us and any material filmed or recorded at the Event may only be used for the personal, non-profit making enjoyment of amateurs. No recording is allowed in the conference.

EVENT TIMINGS AND ADMISSIONS

a) Please note that advertised start times of events are subject to change. Also, door opening and closing times stated in relation to an event are not indicative of the event’s start or end time (or when talent is scheduled to play or the length of the talent’s performance), all of which remain at the Organiser’s discretion and may be subject to change.
b) Tickets are sold subject to the Organiser’s right to change, alter or vary the programme of an Event (including, but not limited to changes to the number of stands, timings, speakers, date or venue) at any time.
c) The views and opinions expressed by any talent, speaker, exhibitor, sponsor, visitor or attendee at the Event are their own. The Organiser shall not be responsible for any advice given or view expressed at the Event or in any material provided to you.
d) By registering / purchasing tickets, you consent to being photographed, filmed or recorded at the event, and for their likeness, mannerisms and/or voice to be included in any content from such filming, photographs and/or recording (and edited) without compensation and/or credit, which content may be communicated and/or used in any and all media worldwide in all perpetuity.
e) Special effects, which may include sound, audio-visual, lighting effects may be featured at an event, which may not be suitable for those with photosensitive epilepsy, or similar conditions.
f) Generally, every effort to admit latecomers will be made at a suitable break in the event, but admission cannot always be guaranteed.

SECURITY

a) The Organiser reserve the right to refuse admission to the venue, or to remove any person from the venue for reasons of public safety. Please act responsibly. Any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle the Organiser to eject you from the venue.
b) Searching is a condition of entry to the event. You may be body/bag searched at the entrances by security, on the site or when leaving. 
c) Any item(s), reasonably considered for use as a weapon, which may cause danger, offence or disruption to any other person, must be surrendered to staff. 
d) Anyone found in possession of illegal drugs / substances will be refused entry / ejected from site and may be handed over to the police.

EVENT CANCELLATIONS IN FULL, POSTPONEMNENT, RESCHEDULING AND ALTERATION

a) If an event is cancelled, rescheduled or altered, we will get in touch with you to let you know once we have received the relevant information (if you book online, we will use your email address). However, we cannot guarantee that you will be informed of such cancellation, rescheduling or alteration before the date of the event. It is your responsibility to ascertain whether an event has been cancelled, rescheduled or altered and the date and time of any rescheduled event.
b) We are not responsible for any tickets not purchased through us, accordingly if there is cancellation of, or significant change to, the event, we will not be liable to you for a refund for the ticket.
c) Cancellation: Should the Event be cancelled in full with no intention of rescheduling, your order will be cancelled, and you will be refunded the Sale Price of your Tickets or Packages You will not be compensated for any losses e.g travel costs.
d) Rescheduling: If an event for which you have purchased Tickets or Packages is rescheduled, Tickets and Packages will be valid for the new date (or you will be offered Tickets or Packages of a value corresponding with your original Tickets or Packages for the rescheduled event, subject to availability). If you notify us within 7 days that you are unable to attend the rescheduled event, you will be able to cancel your order and obtain a refund of the Sale Price of your Tickets or Packages. Failure to notify us within 7 days that you are unable to attend the rescheduled event will be deemed to be a reconfirmation of your order for Tickets or Packages for the rescheduled event, and you will not be able to claim a refund.
e) Refunds will be made using the same means of payment as you used for the initial purchase.

TICKET CANCELLATION BY YOU

a) Tickets and Packages cannot be exchanged or refunded after purchase. It’s important to read the Tickets Terms and Conditions before booking.
b) Please make sure you will definitely be able to travel to the event before you book. Make sure you are covered by your own travel insurance, in case something unexpected comes up.

DAMAGE / LOSSES

a) The Organiser is unable to accept any liability for personal or property damages, losses (including surrendered items) or injuries sustained at this event - other than caused as a result of our negligence.  
b) We may prosecute You if You cause damage to the Venue, the Venue infrastructure, or cause harm to any other person at the Event and/or Venue.
 
HEALTH & SAFETY

a) You must comply with any and all instructions given to You by Us, Venue and/or Event staff and stewards.
b) Smoking is not permitted. This includes e cigs
c) You will not be allowed to bring any glass bottles of any kind into the Event. There are no exceptions.
d) You are strongly recommended to consult with your physician or other health care professional before beginning any exercise program. This is particularly true if you (or your family) have a history of high blood pressure or heart disease, or if you have ever experienced chest pain when exercising or have experienced chest pain in the past month when not engaged in physical activity, smoke, have high cholesterol, are obese, or have a bone or joint problem that could be made worse by a change in physical activity. Do not take part in the dance fitness workshop if your physician or health care provider advises against it. You should be in good physical condition and be able to participate in the exercise. If you experience faintness, dizziness, pain or shortness of breath at any time while exercising you should stop immediately. I understand that there is a risk of injury associated with participating in the dance fitness workshop.I hereby assume full responsibility for any and all injuries, losses and damages that I incur while attending, exercising or participating in the dance fitness workshop. I hereby waive all claims against the Organiser and its instructors, or partners of individually or otherwise, for any and all injuries, claims or damages that I might incur.
f) You voluntarily assumes all risk and danger incidental to the event whether occurring prior to, during or subsequent to the actual event, including any death, personal injury, loss, damage or liability.

HOUSEKEEPING

a) Please use the bins and recycling points provided on and off site. 
b) No animals, other than guide or hearing dogs, are permitted on site.

LIMITATION OF LIABILITY

QUERIES, COMPLAINTS AND DISPUTE RESOLUTION

a) If we need to contact you, we will use the contact details you provided at the time of purchase. It is your responsibility to inform us immediately of any changes to your contact details, whether before or after receipt of Items. In particular, please ensure that you provide us with a valid email address as this is our preferred method of contacting you. You should also be aware that your email mailbox settings may treat our emails as junk, so remember to check your junk and/or spam folders.
b) If you have any queries or complaints regarding your purchase, please contact us at events@curlytreats.co.uk quoting any order reference numbers.
c) Your query or complaint shall be acknowledged by us as soon as possible and in any event, within five business days of receipt.
d) We may need to contact one or more Event Partners for more information before responding to your query or complaint.
e) If any dispute arises, we shall use our reasonable endeavours to consult or negotiate in good faith and attempt to reach a just and equitable settlement satisfactory to you, us and any relevant Event Partner. Please note, some complaints can take as much as 28 days to resolve.
f) Nothing in this Terms and Conditions affects or restricts your statutory rights, your right to make a complaint to Trading Standards or another appropriate regulatory authority, or your right to pursue court proceedings or other forms of dispute resolution.

GENERAL

a) If we delay or fail to enforce any of the provisions of these Tickets Terms & Conditions, it shall not mean that we have waived our right to do so.
b) We shall be entitled to assign our rights and obligations under this Tickets Terms and Conditions provided that your rights are not adversely affected.
c) If any provision of this Tickets Terms and Conditions is found by a competent court to be invalid or unenforceable, that provision shall be deemed to be omitted from this Tickets Terms and Conditions and this shall not prevent the other provisions from continuing to remain in full force and operate separately.
d) If any provision of this Tickets Terms and Conditions is or becomes illegal, invalid or unenforceable pursuant to the law of any applicable jurisdiction, this shall not affect or impair the legality, validity or enforceability in that jurisdiction of any other provision of this Tickets Terms and Conditions.
e) Any of our and our Event Partners’ affiliates, successors, or assigns may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999. Except as provided in the previous sentence, these Tickets Terms and Conditions does not create any right enforceable by any person who is not a party to it but does not affect any right or remedy that a third party has which exists or is available apart from the Contracts (Rights of Third Parties) Act 1999.
f) Nothing contained within these Tickets Terms and Conditions and no action taken by you or us pursuant to this Tickets Terms and Conditions shall create, or be deemed to create, a partnership, joint venture, or establish a relationship of principal and agent.
g) Any notice provided under this Tickets Terms and Conditions shall be delivered upon receipt and shall be deemed to have been received at the time of delivery (if delivered by hand, registered post or courier) or at the time of transmission (if delivered by email).
h) This Tickets Terms and Conditions shall be governed by and construed in all respects in accordance with English law and both you and we agree to submit to the non-exclusive jurisdiction of the English courts in relation to any dispute arising out of or in connection with this Tickets terms and Conditions.
